For Dispute Protection

PresolvSecure will save you from all the troubles that come along with disputes, especially those that end up in court. Before securing yourself, let's ensure that:

1. You have an existing agreement or are going to enter into a new agreement.

2. Your agreement must be a valid agreement i.e. must fulfill all requirements of a valid contract as per the applicable laws.

3. Consent of all parties is required to validate PresolvSecure for your agreement.

RAISING A DISPUTE

When a dispute arises and your agreement is secured by an active PresolvSecure plan, you can simply login and raise a dispute by filling the details alongwith a proposed resolution

VERIFICATION

Upon submission of the dispute, a case manager will be assigned to you who will study your case and verify your dispute

COMMUNICATION

Upon verification, the counterparty will be intimated about the dispute, who can either accept the proposed resolution or propose a counter-offer

COUNTER-OFFER

Upon verification and communication of the counter-offer, the initiating party may choose to accept the counter-offer or make a final offer

RESOLUTION AND SETTLEMENT

The counterparty may either accept the final offer, in which case a settlement agreement will be drawn up and the dispute will be closed

ESCALATION

In case the counterparty does not accept the final offer the dispute will be automatically escalated


CERTIFIED EXPERT

An empaneled Certified Expert will be assigned to the case who will facilitate the dispute resolution process. Allocation of a case to the expert will be based on the expert's competence, knowledge and ability to deal with subject matter of the dispute between the parties

DISPUTE RESOLUTION PROCESS

Depending upon the nature and circumstances of the dispute and the complexity involved, the Certired Expert, will recommend and implement the most suitable course of action and the most appropriate Alternative Dispute Resolution ('ADR') mechanism for resolving the dispute collaboratively

RESOLUTION AND SETTLEMENT

Once a resolution / settlement is arrived at a settlement agreement will be drawn up and executed by all the disputing parties
